A representative for Warner Music (WMG.O), which is a defendant in the case, declined to comment. Hines first sued over the songs in 2019, arguing they copied part of the introduction to his song. Oetken agreed that Hines' song "borrows from a heavily used work that is in the public domain" and "adds only material that is not original enough to be copyrightable."

Circuit Court of Appeals in Manhattan rejected the Cuban-born umpire's arguments that the league's promotion practices, including its failure to promote him to crew chief, reflected unfair treatment of minorities. Hernandez, an MLB umpire since 1993, claimed he had been discriminated against because he was passed over for crew chief five times between 2011 and 2018, and last umpired a World Series in 2005. In 2020, MLB named Kerwin Danley its first black crew chief and Alfonso Marquez its first Hispanic crew chief born outside the United States. The first Hispanic crew chief was Richie Garcia, who was elevated to that role in 1985.

A federal judge Monday tossed the bulk of a public-corruption case against former New York Lt. Gov. Brian Benjamin , finding the Justice Department’s charges didn’t meet the legal bar for prosecuting alleged bribery involving campaign contributions. U.S. District Judge J. Paul Oetken in Manhattan threw out three corruption charges against Mr. Benjamin, a Democrat who was indicted earlier this year on five criminal counts for allegedly soliciting campaign donations from a real-estate developer in exchange for steering $50,000 in state funds to the developer’s education nonprofit in Manhattan’s Harlem neighborhood.

Bribery and fraud charges against former New York Lt. Gov. Brian Benjamin were tossed out Monday by a federal judge, leaving Benjamin to face only records falsification charges and prompting his lawyers to say it was tragic that the case was ever brought. Benjamin, a Democrat, resigned after his arrest last April. During a state Legislature career that began in May 2017, he emphasized criminal justice reform and affordable housing. The charges that were left intact allege that Benjamin knowingly made a false entry in a record with the intent to impede an investigation.

Rudy Giuliani will not face criminal charges in a grand jury investigation that looked into whether he violated U.S. lobbying laws in his dealings with Ukraine, prosecutors said Monday. Ambassador to Ukraine Marie Yovanovitch and whether he ran afoul of the Foreign Agents Registration Act. Robert Costello, Giuliani’s attorney, told NBC News that he and his client are pleased with the formal decision not to bring charges in that investigation is now public. Costello, a former U.S. attorney in the office Giuliani once led, said Monday that it was unusual for prosecutors to release letters like the court filing revealing no charges against Giuliani. The judge presiding over that case, Arthur Engoron, said a decision outlining her specific "duties, powers and fees will be "forthcoming shortly."

Former New York City Mayor Rudy Giuliani will not face criminal charges in an investigation into whether he violated U.S. lobbying laws while doing business in Ukraine, federal prosecutors told a judge Monday. The grand jury was examining whether he violated the U.S. Foreign Agents Registration Act, and his attempts to oust Marie Yovanovitch, the American ambassador there. Williams asked the judge in the same letter to terminate the appointment of former federal judge Barbara Jones as a special master, or watchdog, to review documents seized from Giuliani. Giuliani, along with Trump, still faces an ongoing criminal probe by a grand jury in Georgia, which is investigating interference in that state's presidential election in 2020. Giuliani's license to practice law in Washington, D.C., soon after was suspended automatically as a result of the New York suspension.

In a sign that the investigation was winding down, FBI agents returned the seized electronic devices to Giuliani, his lawyer said in August. Giuliani, 78, also faces a state-level criminal investigation in Georgia over efforts by Trump and his allies to overturn his 2020 election loss to Biden. Giuliani in 2020 urged the state's lawmakers not to certify Biden's victory in Georgia. In August, Giuliani testified before a Fulton County grand jury after a judge ordered him to comply with a subpoena.
